FlowerShopNetwork.com content also appears on www.FSNf2f.com, a website for Flower Shop Network members. Flower Shop Network also allows its content to be used on the hosted websites it creates for member florists.

1.2 Permitted Use by Members Members
Members may use select content for promotional purposes with appropriate credit and linkage.

1.3 Prohibited Use No content may be used to:

SECTION 3: Terms of Service - Websites Hosted by Flower Shop Network
3.1 Scope
These terms apply to websites hosted by Flower Shop Network on behalf of florist customers.

3.2 Customer Responsibilities
Customers are solely responsible for the content published on their websites. This includes:

Ensuring proper copyright ownership or licensing;
Avoiding publication of illegal, harmful, or infringing material;
Compliance with all applicable laws.
3.3 Indemnity
Customers agree to indemnify Flower Shop Network for claims arising from content they publish or upload.

Customer Indemnity Clause for Hosted Websites
The customer acknowledges and agrees that they are solely responsible for all content—whether written, visual, or otherwise—submitted to or displayed on their hosted website. This includes, but is not limited to, text, images, logos, graphics, trademarks, videos, and any other media (collectively, “Customer Content”) provided by the customer or submitted at their request.

The customer represents and warrants that they have obtained all necessary rights, licenses, and permissions to use and display the Customer Content, and that such use does not infringe or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.

The customer agrees to fully indemnify, defend, and hold harmless Flower Shop Network, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Any Customer Content placed on the hosted website by the customer or at their direction;
Any claim that the Customer Content infringes upon the copyright, trademark, or other intellectual property rights of a third party;
Any violation of law, regulation, or third-party rights resulting from the Customer Content.
This indemnification obligation will survive the termination or expiration of the customer’s relationship with Flower Shop Network, Inc.
3.4 Account Termination
Flower Shop Network reserves the right to suspend or terminate services in response to repeated or severe policy violations.

SECTION 4: DMCA Policy - Hosted Customer Websites
4.1 DMCA Compliance
Flower Shop Network complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

4.3 Takedown Procedure
Upon receiving a valid DMCA notice, we will:

Verify the claim;
Remove or disable access to the allegedly infringing content;
Notify the website owner.
4.4 Counter-Notice
If the website owner believes the takedown was in error, they may file a counter-notice. If valid, content may be restored unless a legal claim is filed.

4.5 Repeat Infringer Policy
Accounts that show a consistent pattern of infringement after being informed of compliance procedures may be suspended or terminated.

4.6 Safe Harbor
As a hosting provider, Flower Shop Network acts in a neutral capacity and responds to valid DMCA requests. We do not actively monitor hosted content. Flower Shop Network may revise these policies at any time.
